women in oakland. police say that one man is responsible for two attacks near lake merritt. those attacks both happened on sunday night within hours of each other. two women were robbed and then sexually assaulted in a relatively secluded area. police believe it was the same attacker in both case. women in the neighborhood are told to stay in well lighted areas with other people around. >> nervous, wish i could find someplace else to walk. >> everybody especially people by themselves are all walking around with an ipod in their ear. >> police say that using an ipod or even your cell phone can make you a more likely target. they are also warning people to lock their doors when they get in their car and, of course, be very careful when getting out. a woman in the south bay says a man pushed her into an act duct and tried to sexually assault her when she was jogging sunday morning near snell and colleen in san jose.

the woman says the man was in his 20s and ran away after she fought him off. police in south san francisco are now looking for a man they believe manipulated his mentally disabled girlfriend into prostitution. this is the suspect, a 27-year- old man. he was advertising his 21-year- old girlfriend, according to investigators, on various website through the san mateo county. police found the woman but not the man. anyone with information should call the south san francisco police department. san jose police are investigating a car crash that killed an 18-year-old this morning. it happened on almaden expressway near o'grady drive about 3:00 a.m. police say that the car first hit a light pole and possibly a tree causing the suv to catch fire. the teenager had died was the passenger in the car. >> it appears they drifted off the rose and hit a signal pole.

the car spun off of that, continued down almaden expressway approximately 100 feet and then was engulfed into flames. >> police found the driver of the car wandering a few blocks away from the crash site. he is also 18 years old. he has been arrested or suspicion of driving under the influence. he is facing allegations of hit- and-run because left the scene of the accident. and the chp says a novato high school teenager was drunk when he crashed his car last friday killing 15-year-old isaac bratt. the unidentified 16-year-old driver is being held on charges that include vehicular manslaughter. two of the four survivors in the car including the driver are still in the hospital. a vallejo man is in jail accused of kidnapping and killing his girlfriend. >> he will be charged with murder. >> police believe 39-year-old william ubando used a baseball bat to beat his girlfriend, 33-

year-old ritchie camped. campuded. he drove around and showed up at american canyon and asked a co-worker to come out and look at his girlfriend's body. the coworker called 911. police say urban doe ubando confessed. a citywide liquor tax and banning tobacco sales are to be voted on today. anne makovec reports. >> reporter: today we are expecting a second reading of the alcohol fee not a tax, that's how they can get away with not passing it by the voters there. might be a vote on that today and they are also tackling another vice, cigarettes, though some people are afraid there could be a jab at the local economy. it's the kind of thing that can give a guy a headache. a stiff drink with the chaser in the form of a fee. >> they are hurting business.

>> reporter: the plan in front of the san francisco board of supervisors and alcohol cost recovery fee, anyone who sells alcohol, beer or wine for drinking on premises is charged to cover the cost the city pays for drunk patrons. here's how the fees break down. for beer 4.3 cents per 16-ounce glass. 6 six sense, and hard liquor 2.5 cents for shots. >> the whole principal is violating taxing without representation. >> reporter: the ordinance says alcohol use costs california more than $30 billion a year between healthcare, criminal justice and property damage and that san francisco has more of its share of drinkers 55% of american adults considering themselves drinkers while two- thirds of san franciscans do. >> put a bill through and have the voters vote on it just like cigarette taxes. >> reporter: cigarettes aren't immune from the board of supervisors, either.

they are discussing a measure today that would take an old ordinance a step farther including grocery and big box stores and a ban on selling tobacco in pharmacies. >> that's fine. there's other places to get cigarettes. i can understand, there's kids in grocery stores. >> i don't think the city should be able to make that decision for anyone where to buy cigarettes. >> reporter: with both measures there are fears it's the consumer who will pay. this manager thinks only select businesses will be able to absorb the cost. >> if you have a decent margin. if you are a struggling business, then you're in trouble. >> reporter: the mayor has promised to veto the alcohol fee if it does indeed pass. we actually contacted all of the supervisors today and we only heard back from one of them who we were not able to speak with on camera by our deadline, unfortunately. if they do get enough votes, though, eight votes they could override mayor newsom's veto if he does in fact do that. >> so, fee, not tax, bottom

line prices go up. >> reporter: sure smells like a tax, that's what a lot of folks are saying. >> anne makovec in san francisco, thank you. well, after calls from politicians and the public, pg&e has now posted maps showing the locations of the riskiest gas pipelines in the state. there there or has there been third party construction in the area? is there any pipe corrosion? has there been any land movement near the pipe such as an earthquake? and finally, the pipe's age, design and what it's made of. those are the factors that put the pipes on the list. the factors constantly affect the list. >> this list is in flux. some items will move up the list. some items will move down the list. >> pg&e says the san bruno section of pipe that exploded was not on the top 100 list. when the utility finds out what caused the explosion, it says it might have to change the list criteria. the utility says the maps on

focused on the gentler nature. every week, leo now visits the cancer care center in mountain view. the purpose, of course to connect with patients who know what it's like to be hurting and trying to recover. >> i see him, it's a joy. i mean, you know, he just makes me feel good inside. it feels good to feel good these days. >> leo looks like he feels pretty good, too. the 51 pit bulls taken from michael vick's property, only four of those 51 could be rescued. the others have new lives and homes around the country. all right. it's a key vote. could happen at any time. the senate is now considering a bill to end the military's "don't ask, don't tell" policy. why many senators are being pulled in both directions. >> why this is the last time you will see this. and what does the last day of summer hold for the bay area? so far, so good. plenty of sunshine outside but your temperatures, eh, they are cooling down a bit.

we'll take a look at today's cooler highs in just a few moments. ,, [ male announcer ] jerry brown's good old days. but what really happened? cnn -- not me -- cnn says his assertion about his tax record was "just plain wrong." jerry brown went out there and took credit for the fact that the people of california voted for proposition 13, which lowered taxes, which he opposed. and now he's going around taking credit for it. he raised taxes as governor of california. he had a surplus when he took office and a deficit when he left. he doesn't tell the people the truth.

to get rid of the military's "dont' ask, don t tell a crucial vote is expected in the senate on whether to get rid of the military's "don't ask, don't tell" policy. joel brown shows us with election day around the corner, it's sure to be a close vote. >> reporter: senators are set to cast a key vote later today on whether gay men and women will be able to serve openly in the military. democrats are moving forward to vote on the "don't ask, don't tell" law but most republicans are lining up to stop the measure in its tracks. arizona's john mccain argues military commanders believe it's too soon. >> all of them have said they wanted a complete study about the effect on morale and battle

readiness of their respective services before moving forward. >> reporter: defense secretary robert gates, who supports getting rid of the policy, ordered a study into how repealing it would affect the armed forces. the results of that study are due in december. but elections are coming in november and both sides see a chance to score political points in the debate over "don't ask, don't tell." even pop stars are lending their voices to the discussion. >> "don't ask, don't tell" is wrong. >> reporter: lady gaga is better known for her outrageous outfits. but she is taken and strong stand on "don't ask, don't tell" calling on fans to speak out. >> we should send home the prejudice -- [ screaming ] >> reporter: supporters arguing that wartime is not the right time to make such a big change in the armed forces. but with polls showing most americans support repealing

"don't ask, don't tell," senators are being pulled in both directions. joel brown, cbs 5, washington. >> the senate has just taken a vote to stop the debate and that voiced pass 56-43. so we'll have the very latest on what happens now coming up at 5:00 tonight. 2010 is the deadliest year now for international forces in afghanistan. that's since the war began nine years ago. a nato helicopter crashed overnight in a remote region of southern afghanistan. ten troopers were killed, most americans. commanders don't know what brought it down but the taliban claims insurgents shot it down. nato says there were no reports of enemy fire in the area. sources are telling cbs news the helicopter was flying a secret mission in a taliban- dominated region. after 26 years and 38 missions, the shuttle discovery is on the launch pad for the last time ever. nasa moved discovery out of its hangar last night and onto the

launch pad at the kennedy space center in florida this morning. the discovery will go to the international space station on november 1. then in february, the space shuttle endeavour lifts off wrapping up 30 years of shuttle flights. infestations are exploding all over the country. now the first ever bedbug summit is under way so popular it sold out. >> the calendar may say we are moving into fall but it won't feel like it. you know what? summer never felt like summer either. so that's not really a big deal there. temperatures expected to be in the 90s this weekend. yeah, we'll take a look at your seven-day forecast coming up. ,,,,,,,,,,,,,,

okay. i was looking forward to the warmup. but i got to go through a cooldown before i -- >> you have to go through a cooldown -- >> to really appreciate the warmup. although it looks nice. look at the bridge. >> really nice. there's going to be another nice day but temperatures not as warm as yesterday so the cooldown comes first. but you don't like cooler weather? just wait a couple days because 90-degree temperatures are in store for the weekend. looking out toward the golden gate bridge there, i like that shot because it kind of sums up what's going on along the coastline. and plenty of sunshine, partly cloudy conditions are expected. cool temperatures and breezy. temperatures up to the lower 60s.

sun and clouds expected around the bay with temperatures just near 70 degrees in our warmest spots. and sun and clouds but not as warm inland today with temperatures in the mid-70s. so here's what we're watching. i mentioned a cooldown. here's why. more clouds coming into play courtesy of a frontal system. and that's going to cool us down, give us more clouds, and temperatures today up to 8 degrees cooler. 71 in fremont, 72 degrees in santa clara, 71 in mountain view, 70 degrees in palo alto and the lower 60s just along the coast line here. east bay locations you enjoyed the 80s yesterday. today the mid-70s. pittsburg to antioch to brentwood. and the lower 70s in pleasant hill and danville and dublin and pleasanton. along the bay mid-60s in berkeley, 69 oakland, 70 san leandro, 69 degrees in hayward. san francisco from 69 to 64. 64 san leandro. 70 san rafael. 69 novato. and the mid-70s in fairfield,

napa, sonoma, and 72 in petaluma. the cooldown, that's today. we'll continue to see cooler temperatures in store for tomorrow a lot like today and then thursday, the transition day. that's when things begin to change. friday, saturday, sunday, are those 90-degree temperatures i see in yeah. they are. especially inland. mid-90s expected near 80 around the bay, lower 70s at the coast. not so bad for the first fall weekend. puffy clouds and doggies, by heather peterson, mypix photo for the noon hour. that's a cute photo. >> those are two peas in a pod. >> the one on the right looks like he posing. >> i i'm glad summer is showing up. fall is going to begin. >> you know what? yeah. at least it's showing up. >> thank you. well, these are showing up all over the country. bedbugs getting so bad in some places, the first-ever bedbug summit is happening in chicago.

susan coppin shows us not only sold out, it's standing room only. >> reporter: it's been the year of the bedbug. no bigger than an apple seed, these little bloodsuckers have caused big problems, taking another bite in the big apple this past weekend when an infestation shut down niketown's flagship store in new york city. the latest addition to a growing list of retailers, corporations, even the empire state building overrun by bedbugs. according to a study by termin inix, new york city is the highest infestation, ohio the lowest number of bugs. >> there are many more places where bedbugs will be found. it's been building up for years. >> reporter: experts say it's a pandemic building for years with no end in sight. >> how many cities in america have bedbugs? >> how many cities are there? [ laughter ] >> reporter: phillip cooler is ceo of bedbug central, which is

hosting the first annual north american bedbug summit in chicago a sold-out event. why so many bedbugs? >> nobody knows. >> reporter: in the past year, 95% of pest control companies have encountered bedbug infestation. i'm in hotels every week. what are my chances that i'm bringing home bedbugs? >> huge. you are going to. >> reporter: on display here in chicago, the all-out assault against bedbugs. from bags for your suitcases -- so you trap the bedbugs in here? >> absolutely. >> reporter: -- to steamers for your mattress and everything in between. is there a light at the end of the tunnel? are we going to get rid of them? >> at bedbug central we believe there is light at the end of the tunnel. the question is when. >> well, susan also tells us, getting rid of those bedbugs can be expensive.
